1. Your Agreement

Welcome to MushOh.io! These Terms of Service ("Terms") are a binding legal agreement between you, the Parent or Legal Guardian ("Parent," "you"), and MYCOHIO LTD dba MUSH OHIO ("Company," "we," "us," or "our"). These Terms govern your and your child's ("Child," "User") use of the MushOh.io platform, including our website, associated services, and content (the "Platform").

By creating an account or using the Platform, you agree to these Terms on behalf of yourself and your Child. You are responsible for ensuring your Child understands and follows these rules. If you do not agree to these Terms, you may not use the Platform.

2. Parent-Managed Accounts

To use the Platform, you must be at least 18 years old and legally permitted to enter into this agreement. You must:

• Provide accurate and complete registration information for your parent account.
• Maintain the security of your account password. You are responsible for all activity that occurs under your account.
• Promptly notify us if you suspect any unauthorized access to your account.
• Obtain verifiable parental consent as described in our Privacy Policy before your Child accesses or provides any information to the Platform.

3. Our Code of Conduct

We want MushOh.io to be a safe, respectful, and fun environment. You and your Child agree to follow these rules:

• Be Kind and Respectful. Do not post anything that is mean, bullying, harassing, or hateful towards others.
• Protect Personal Information. Do not share private information like a full name, home address, phone number, email address, or school name in any public posts.
• Keep Photos Safe. Do not upload any photos or videos that include people, especially recognizable faces. Photos should only be of your science experiments.
• Be Honest. Do not impersonate someone else.
• Use the Platform as Intended. Do not attempt to cheat, hack, or disrupt the Platform or its security features.
• Respect Others' Creations. Do not copy or steal other users' observations or content.

We reserve the right to remove any content and suspend or terminate any account that violates this Code of Conduct without notice.

4. User Content and License

4.1 Your Content

You and your Child can post content to the Platform, including notes, observations, and photos ("User Content"). You own the User Content you create.

4.2 License You Grant to Us

To operate the Platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify (e.g., to create a timelapse GIF), and display your User Content for the limited purpose of:

• Displaying it within your and your Child's account.
• Providing and improving the features of the Platform.
• If you give explicit, opt-in consent for a specific post, for displaying that User Content publicly on the Platform.

This license ends when you delete your User Content or your account, though we may retain backup copies for a reasonable period of time as described in our Privacy Policy.

4.3 Prohibited Content

You may not submit User Content that violates our Code of Conduct or is otherwise illegal, infringes on intellectual property rights, or contains malware.

5. Our Intellectual Property

The Platform itself, including our logos, graphics, software, badges, and all other content provided by us ("Platform Content"), is owned by or licensed to us and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, revocable license to access the Platform for personal, non-commercial, educational use. You may not copy, modify, or reverse-engineer our Platform or Platform Content.

6. Fees and Payments

Access to the Platform requires the purchase of a science kit from our website. All payments are processed through a third-party payment processor. By making a purchase, you agree to their terms and to pay all applicable fees.

7. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT GUARANTEE THAT IT WILL ALWAYS BE PERFECT, SECURE, OR AVAILABLE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE PLATFORM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

8. Indemnification

You (the Parent) agree to indemnify and hold harmless the Company and its employees from any claims, damages, or expenses (including legal fees) arising from your or your Child's use of the Platform or violation of these Terms.

9. Termination

You can terminate this agreement at any time by deleting your account. We may terminate or suspend your account without notice if you or your Child violates these Terms, especially the Code of Conduct.

10. Governing Law

These Terms are governed by the laws of the State of Ohio, USA.

11. General Terms

These Terms, along with our Privacy Policy, make up the entire agreement between you and us. If we make material changes to these Terms, we will provide notice to you at the email address associated with your parent account.
